TERMS OF USE OF THE SITE

Continued browsing of the website www.allmeteorite.com (hereinafter referred to as “the Site”) implies unreserved acceptance of the following provisions and Terms of Use and of the privacy policy (Article 8).
The version of these Terms of Use currently online is the only one enforceable during the entire period of use of the Site and until a new version replaces it, if necessary.

Article 2 – Access to the Site

Access to the Site and its use are reserved for strictly personal use.
You agree not to use the Site and the information, data and photographs contained therein for commercial, political or advertising purposes or for any form of commercial solicitation, in particular the sending of unsolicited emails.

Article 3 – Content of the Site

All trademarks, photographs, texts, information, publications, comments, illustrations, images, animated or not, video sequences, as well as all computer applications that could be used to operate the Site and more generally all elements reproduced or used on the Site are protected by the laws in force under the intellectual property.
They are the full and complete property of the Editor or its partners.
Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the Editor, is strictly prohibited. The fact that the Editor does not initiate proceedings as soon as he becomes aware of these unauthorized uses does not mean that he accepts the said uses and waives any legal proceedings.
Similarly, any link or framing of the Site is subject to the prior written authorization of the Editor.

Article 4 – Management of the Site

For the good management of the Site, the Publisher may at any time :

  • suspend, interrupt or limit access to all or part of the Site, reserve access to the Site or to certain parts of the Site to a specific category of Internet users ;
  • delete any information that may disrupt the operation of the Site or that contravenes national or international laws ;
  • suspend the Site in order to proceed to updates. The Editor could not be held responsible for this suspension in the event of update, problems of maintenances or repairs.

Article 5 – Responsibilities

The responsibility of the Editor cannot be engaged in case of failure, breakdown, difficulty or interruption of functioning, preventing the access to the Site or to one of its functionalities.
The equipment you use to connect to the Site is your sole responsibility. You must take all appropriate measures to protect your equipment and your own data, in particular from viral attacks via the Internet. You are also solely responsible for the sites and data you consult.
The Editor cannot be held responsible in case of legal proceedings against you:

If the Editor was to be the object of a friendly or legal procedure because of your use of the Site, it will be able to turn against you to obtain compensation of all the damage, sums, condemnations and expenses which could result from this procedure.
The Website Editor strives to provide information that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies and shortcomings, whether in the content itself or in the updating, whether they are of its own making or of the making of third-party partners who provide it with this information.
All the information proposed on the Site is given as an indication, is not exhaustive, and is likely to evolve. It is given subject to modifications having been made since it was put on line, and subject to the evolution of science on the subject of which the Editor cannot have knowledge.
Finally, in the case of an Order placed from the Site (see article 7 below), it is specified that ALLMETEORITE, in the online sales process, is only bound by an obligation of means: it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, breakdown of service, fraud involving the User’s bank card or bank details, or other involuntary problems.

Article 6 – Products

The essential characteristics of meteorites and other objects related to meteorites (hereinafter referred to as “Products”) are presented on the Site under each product sheet.

Article 7 – Order

The Customer must respect the following steps to place an order:

  • The Customer selects the Product(s) of his/her choice and the quantity of Products desired and adds them to his/her virtual basket
  • The Customer checks the nature of the Products added to the basket
  • To delete an item, the Customer must click on “Delete” and to change the number of items click on “Update”.
  • The Customer can then finalize the order or choose to continue shopping
  • To conclude the contract and finalize the order, the Customer fills in the order form and indicates the personal data necessary for the order
  • The Customer must choose the delivery method
  • It is the Customer’s responsibility to check the details of the order and in particular the total price of the order taking into account the price of the Products, the delivery terms and costs, the VAT, the Product in particular in terms of quantity
  • The Customer must read and accept the GTC.
  • The Customer must choose his payment method (Paypal, bank transfer or credit card)
  • The Customer must proceed to the payment

The Customer must check the accuracy of the information he/she provides.
The contract is deemed to have been concluded upon receipt by ALLMETEORITE of the order and after verification by the latter of the accuracy of the data relating to the start.
Any order will be validated only after acceptance of the payment.
ALLMETEORITE reserves the right to refuse any order within 24 hours of receipt, in particular in the event that the quantities ordered are abnormally high in relation to the quantities usually ordered by purchasers in their capacity as end-users and depending on the stocks available.
If no reply is received within this period, the order is deemed to be definitively accepted by ALLMETEORITE.
All orders that have been validated and paid for are irrevocable for the Customer, beyond the withdrawal period that may be available to him in accordance with article 6 hereof.
However, the Customer may submit to ALLMETEORITE a request for modification or cancellation of the order, in writing, no later than 24 hours after validation and payment of the order. ALLMETEORITE is free to accept or refuse any request for cancellation or modification of the order. Any modification or cancellation is only validly binding on ALLMETEORITE if it has been expressly accepted in writing.

Article 8 – Protection of personal data – privacy policy

By using the Site, you (the User) consent to its privacy policy.
In the course of its activities, ALLMETEORITE may collect and process some of your personal data, in particular via the contact form or in the case of orders, which identify you directly or indirectly. For this reason, article 8 of these conditions of use informs you about the collection and use of your personal data and draws your attention to the rights you have in this respect, in the context of the General Data Protection Regulation 2016/679 (hereinafter “GDPR”) and the law n° 78-17 of January 6, 1978 relating to data processing, files and freedoms.

8.1 Collection of personal data

The personal data that are collected on the Site are the following:

• Contact form
If you wish to contact the Site Editor, you will use a contact form on which you will have to communicate your name, first name, e-mail, date of birth, telephone number and e-mail address in order to be contacted by the Editor.
Thus, all the data used by ALLMETEORITE is data that you yourself provide.
According to the type of data concerned, some are obligatory (in particular your email address) and others are optional.

• Cookies
Cookies are used in the context of the use of the Site. The User has the possibility to deactivate the cookies from the settings of his browser.

• Third party data
For the personal data of third parties delivered on the site (in particular in case of questions asked to the Site Editor, giving for example scientific references), the User guarantees to have obtained the consent of the persons whose data he communicates. The delivery of personal data of minors can only be done by the holder(s) of parental authority.

8.2. Data controller

The data controller is the person or body that determines the objectives and methods of collecting and processing your personal data.
For the Site, the data controller (hereinafter the “Data Processor”) of your personal data is ALLMETEORITE, a single-member simplified joint stock company, registered under number 900 129 149 with the Lyon Trade and Companies Register and whose registered office is located at 59, Boulevard Eugène Réguillon – 69100 Villeurbanne – France.

8.3 Use of personal data

The personal data collected from Users is used to provide and improve the Site’s services and to maintain a secure environment.
More specifically, the uses are as follows:

  • offer to the User the possibility to communicate with the Website Editor;
  • possibility of ordering Products;
  • personalization of the services by displaying advertisements according to the User’s browsing history, according to his preferences;
  • possibility to be contacted again by the Editor for more information;
  • prevention and detection of frauds, malwares (malicious softwares) and management of security incidents;
  • management of possible disputes with the Users;
  • sending information of a scientific nature, or commercial and advertising information, according to the User’s preferences.

8.4 Sharing of personal data with third parties

Personal data may be shared with third party companies in the following cases:

  • when the User authorizes a third party’s website to access his/her data;
  • when the Site uses the services of service providers to provide User assistance or advertising.
    These service providers have limited access to the User’s data, in the context of the execution of these services and have a contractual obligation to use them in accordance with the provisions of the applicable regulations on the protection of personal data;
  • if required by law, the Site may transmit data to follow up on claims made against the Site and to comply with administrative and judicial procedures;
  • if the Site is involved in a merger, acquisition, sale of assets or receivership, it may be required to sell or share all or part of its assets, including personal data. In such a case, Users will be notified before any personal data is transferred to a third party.

8.5 Security and confidentiality

The respect of the private life of the Users and of their personal data is a priority for the Editor and he commits himself to treat the said data in the strictest respect of the French Data Protection Act of January 6, 1978 (“Loi Informatique et Libertés”) as amended and of the General Data Protection Regulation (EU) of April 27, 2016 (“RGPD”).
The Site thus implements organizational, technical, software and physical measures in terms of digital security to protect personal data against alteration, destruction and unauthorized access.
However, it should be noted that the internet is not a completely secure environment and the Site cannot guarantee the security of the transmission or storage of visitor’s information over the internet.

8.6 Users rights

In accordance with the applicable regulations on data protection, you have the following rights

The User may request the Data Controller to access all personal data held about him/her.

• Right of rectification
If the User’s personal data is inaccurate, he/she may request that the information be updated.

• Right of opposition

The User may withdraw his consent given for a specific use; in this case the Data Controller will stop using the data for the purpose in question.
In particular, in the case of consent to receive information and commercial offers from the Data Controller or its partners, the User may withdraw his consent at any time.

• Right to erasure
The User may request that his personal data be deleted or cease to be used.

• Right to organize the fate of his/her data after death
The User has the right to define general and specific directives defining the way in which he/she intends the rights mentioned here to be exercised after his/her death.

• Right to limitation
The User may request to keep the personal data but to stop using them.

• Right to portability
In certain cases provided for by the regulations in force, the User may request the export of such data in a reusable format or the transmission of the data to a third party company that may reuse them.

The Data Controller has a period of 30 days from receipt of the request to provide a response.

8.7. Implementation of Users’ rights

In accordance with the regulations applicable to personal data, Users have the following rights:

    In this case, before implementing this right, the Site may request proof of the User’s identity in order to verify its accuracy;

The Publisher uses the e-mail address provided by the User to send him/her information and updates related to his/her order, occasional company news, information on related products and services, etc. If at any time the User wishes to unsubscribe and no longer receive e-mails, he/she can do so by sending a request to the following e-mail address: contact@allmeteorite.com

8.8. Evolution of the present clause

The Site reserves the right to make any changes to this privacy policy at any time. If a change is made to this privacy policy, the Site will post the new version on the Site. The Site will also inform the Users of the modification by e-mail, at least 15 days before the effective date. Article 9 – Cookies

Article 10 – Photographs and representation of products

The photographs on the Site accompanying the description of the Products, information and services offered by ALLMETEORITE are not contractual and are not binding on the Publisher.

Article 11 – Applicable law

The present Terms of Use are governed by French law and are subject to the jurisdiction of the Commercial Court of Lyon, subject to a specific attribution of jurisdiction arising from a particular legal or regulatory text.
